Real cease-fire or just another 'time out'?

The violence continues in Gaza while negotiations between Hamas and Israel are taking place in Egypt. An estimated 100 Palestinians and three Israelis have been killed so far. NBC's John Ray reports.

Despite rumors of an imminent truce, Israel and Hamas remain miles apart in coming to a real deal. Each side is blaming the other for starting the current conflict ? and both are insistent that the other stop first.

Hamas? leader-in-exile, Khaled Meshaal, summed up his organization?s defiant position at a news conference today in Cairo: ?Let those who started this crazy war stop it, on our conditions.?

Feeling the winds of the Arab Spring at its back, Hamas seems intent on emerging from this conflict stronger than when it entered it. Its conditions include an immediate lifting of Israel?s naval blockade, the opening of all its borders, an end to targeted killings and cross-border raids, and international guarantees that a new status quo will last.

At the same time, Hamas is clear that it has no intention of ending its war against Israel, whose existence it doesn?t recognize and has pledged to destroy. ?Gaza?s demand is not to halt a war,? said Meshaal. ?Its demand is for legitimate rights.?

Israel, meanwhile, is demanding the opposite -- that Hamas shut down all militant activity, including rocket fire by all Palestinian factions, all smuggling of weapons into Gaza -- and insists on its right to go after ?terrorists? inside Gaza in the event of an attack or even a tip-off about a future strike.

In other words, they?re at loggerheads. And so, after a surge of optimism about a deal to halt the violence that has cost dozens of lives in Gaza and three in Israel, reality was settling in late Monday in Cairo.

To add to all the tension, Israel?s Yediot Aharonot newspaper reported another Israeli demand: that if Hamas doesn?t respond to Israel?s demands in the next 48-72 hours, it will launch the ground offensive into Gaza.

Influence of the Arab Spring
In the past, Egypt has been a reliable broker in conflicts involving the Palestinians and Israel, but that was before the Arab Spring drove Hosni Mubarak from power and replaced him with Mohamed Morsi, formerly of the Muslim Brotherhood, an organization whose sworn ambition is to restore a Palestinian state where Israel now lies.

Morsi?s situation is nuanced. Both Hamas and Israel know that he has had to moderate his views since becoming president, in part because he doesn?t want to antagonize Egypt?s powerful military establishment, which -- like much of?Egypt --?does not want to tangle with Israel and is anxious that radical Islamists not ?gain a foothold in??the country. In pursuit of this, he has cracked down on militants smuggling arms across the Gaza border.

In addition, the new Egyptian leader?s task is complicated by the need to appeal to both the Islamists who elected him and the United States, which supplies billions of dollars in aid.

Egyptian critics, such as former newspaper editor Abdel Moneim Said, think Morsi is in over his head and that he can?t deliver a lasting truce. ?This basically means that Egypt has essentially lost its ability to handle the conflict.? Said said. ?There is no [Egyptian] mediator, this time."

That, in essence, boils down to a stare-down between Israel and Hamas: between Israeli Prime Minister Benjamin Netanyahu, who has said that Israel is no longer interested in just another ?time out,? and Hamas leaders such as Meshaal, who on Monday said, with a proud smile on his face: ?We didn?t ask for a truce. The Israelis did!?

At present, a time-out is probably the best that anyone can hope for.

Disappointed after losing the first Test of the four-match series against India, Alastair Cook, the England captain, is heartened by his side?s performance in the second innings of the encounter and hopes for an improved show in the next Test, which begins from November 23, at Mumbai.

With five wickets down at stumps on day four, the England captain felt that he had a small chance of saving the match for his side but he and Prior could not carry on with the good work on the match?s last day.

Cook expressed, ?There was an outside chance: Matty and I knew we would have to do the majority of the work. We got closer and closer and knew India had done a huge amount of overs in the field as well.?

At the half-way stage of the match, after England?s dismal performance in the first innings, it looked as if the rest of the match was going to be a one-sided affair; however, the left-handed opener is delighted with the kind of form his boys showed to make things tough for India.

He added: ?It was a great fight-back. We were in a very tough situation and to get to the last day there is always a glimmer of hope. It had to be something very special - unfortunately it wasn't meant to be today. We need to work hard so when we go to Mumbai we can start again.?

Singapore hotels feel the squeeze as corporate budgets tighten

SINGAPORE (Reuters) - The best may be over for Singapore's booming hotel market as tightening corporate budgets and bank job cuts leave more luxury rooms empty, crimping profits at firms such as CDL Hospitality Trusts .

Singapore runs neck-and-neck with Hong Kong for the title of the world's busiest hotel market, with both boasting occupancy rates that exceeded 85 percent for 2011, according to the two cities' tourism boards. That's higher than in global tourist hot spots such as New York and London.

Hong Kong's occupancy rate may pull ahead of Singapore's in 2013, largely because it has fewer new hotels slated to open. If Singapore's demand stays lukewarm next year, as many hotel operators expect, room rates and profits will slip.

"We will see a slight drop in occupancy rate (in Singapore) mainly due to new supply that is about to come on board in 2013," said Jonas Ogren, Asia director at hotel data provider STR Global, based in Singapore.

"In Hong Kong, we are not seeing so much new supply coming on board, which means the hotels that are already there will continue to do better and better."

The supply of four- and five-star hotel rooms in Singapore is expected to increase by 17.4 percent from 2011 to 2014, while Hong Kong's will grow by just 13.5 percent, according to real estate services firm CBRE.

The city-state's high-end hotels have been hit harder than moderately priced rooms, which suggests that weaker corporate travel rather than tourism is weighing on demand. September's occupancy rate for upscale and luxury rooms dipped to an average of 81 percent, compared with 86 percent for mid-tier accommodations.

Far East Hospitality Trust , which operates 11 hotels and serviced apartments in Singapore, said some customers were downgrading to cheaper rooms.

"The uncertainty in the West and the slowdown in businesses in certain sectors have caused some to cut back on the deployment of expats and corporate travel," Gerald Lee, Far East's chief executive, said in a telephone interview.

"Impact from the financial sector is the most visible," he said.

Demand has eased at Far East's Regency House serviced apartments, a popular choice among visiting or relocating bankers who can rent three-bedroom suites by the month.

CDL, which owns four- and five-star hotels in Singapore, reported weaker-than-expected results on Oct 30 and said its revenue per available room slipped to S$209 ($170) in the July-September quarter from S$217 in the previous three months. That was the highest rate since the second quarter of 2008, just before the Lehman Brothers bankruptcy sparked a global recession that crushed hotel demand.

CDL blamed slowing corporate and conferences demand for the sluggish performance.

RECOVERY STALLS

A booming financial services industry and the launch of two new casino resorts in 2010 helped Singapore's hotels come roaring back after the global financial crisis, which drove down the occupancy rate to just 76 percent in 2009.

But banks have cut jobs and casino revenues have softened.

Other hotel operators, including Hotel Properties Ltd which owns the Four Seasons and Hilton hotels here, are cautious and blame the worsening business environment as the main culprit.

"Singapore's hospitality sector may close the year on a weakened note," Overseas Union Enterprise Ltd , which owns Marina Orchard on Singapore's main shopping belt, said in its third quarter earnings statement.

SOUTHEAST ASIA BOOMS

While's Singapore's hotel market slows, other parts of Southeast Asia are picking up.

Thailand's top two hoteliers, Minor International PCL and Central Plaza Hotel PCL , are benefiting from an expanding economy and a recovery from last year's flooding.

Investors have pushed the shares to record highs. Shares of Central Plaza have more than doubled so far this year, while Minor has surged 87 percent versus a 25 percent rise in the broader index <.seti>.

Units of CDL are up 17 percent on the year, but they have dropped 9 percent since the company released its weaker-than-expected third-quarter results on October 30.

In Indonesia's capital, Jakarta, Jones Lang Lasalle expects average revenue per available room to rise 15 to 20 percent this year versus 10 percent for Singapore.

"Jakarta is going through a big growth spurt, underpinned by a strong economy. (Multinational companies) are expanding, and there's increasing demand for hotels and serviced residences," said Tom Oakden, executive vice president of investment sales Asia at Jones Lang Lasalle Hotels. Alison Redford says U.S. and Canada should use status as an energy powerhouse to do good across the globe

Canada and the United States must use their future petroleum independence to "tilt" the balance of power in the world in "new and unexpected ways," says Alberta Premier Alison Redford.

Speaking at an international defence and security forum in Halifax on Saturday, Redford took issue with suggestions that North America's rising energy production capacity could lead Canada - and especially the U.S. - to disengage from parts of the? world, such as the Middle East, if it no longer depends on foreign oil imports in the coming decades.

Redford said a better choice would be for North America to use its burgeoning energy supplies, and its coming status as an energy powerhouse, as a force for good on a volatile planet, by exporting both energy, and democratic values, to foreign markets.

"We've never been shy about standing up for our ideals in many forums in many ways, whether it's human rights, social justice or democracy," she said. "And energy can help to serve those ends.

"But there will always be the temptation to choose the opposite course. North American energy independence could lead, and some may fear, could lead North America to turn inwards, away from the demands and conflicts of a turbulent world.

"I will tell you that from the perspective of Albertans, we are looking outwards. We are building bridges. We want to open new markets, particularly to Asia."

Redford was participating in a panel discussion on North America's future energy independence, held at the annual Halifax International Security Forum, a gathering of political, military and policy experts.

The discussion was prompted in part by a report last week from the International Energy Agency that predicted the U.S. is set to become the largest oil-producing nation on the planet, producing more than even Saudi Arabia - one day making foreign oil imports into North America redundant.

Future U.S. oil independence is expected to be driven by the development of massive shale oil and gas supplies in North Dakota, Texas and elsewhere - energy reserves once locked deep into underground rock formations, that are now accessible due to new drilling technologies.

If true, the prediction could threaten important existing U.S. markets for Albertan oil, threatening the industry in the oilsands and driving down Alberta's oil revenues.

Finding and securing new, non-U.S. markets for Alberta oil - whether overseas, or in other Canadian provinces - therefore makes sense for Redford from an economic point of view.

But she also said it makes sense from a social, political and human rights perspective for both Canada, and the U.S., to use their new energy power and influence for the advancement of North American ideals.

"As producers, and not just consumers of energy here in North America, we can reassess the global balance of power, and I believe tilt it in new and unexpected ways.

"Over the next two decades, world energy demand is expected to grow by one-third or more," said Redford. "The number of cars on the roads will double, and the United Nations has set 2030 as the goal date for providing universal energy access to the billions that currently live without it.

"More than ever, energy will be a precious resource with stark strategic implications."

Five steps to flourishing health: how treating your friends like dogs ...

Trust your gut, follow your gut? no, no, no?believe in your gut, believe in being well and your gut will guide you.

There?s no arguing that stress affects the whole body. The fight or flight response, for instance, slows digestion and reduces blood flow to major organs. Many seemingly mild daily stressors can trigger mind-body responses.

Trusted in naturopathy, yet arguable in conventional medicine, the psychophysiological effects of the mind on the body are profound.

Centralized in the gut, stress systemically alters the body and brain, either contributing to or causing many diseases such as candida, digestive disorders, parasites, acidosis, obesity, depression, and funky non-diagnosable meanderings like fatigue, aches and brain-fog.

Happiness, on the other hand, promotes gut and overall health.

It?s just so much easier to be affected by stressful, anxious thoughts, especially chronic or prolonged issues that populate people?s minds daily. Continual tending to our inner garden?s ecosystem by balancing good bacteria with the pesky bad is paramount to health. Bad bacteria love acidic environments produced by the standard American diet.

Read. Don?t believe everything, but believe what is intuitively right to you.

We?re all unique, so feel good and proud to do what brings you happiness, however quirky and unconventional it may seem?conventionalism and fashion do tend to be temporary and wearisome.

It?s the small things that count and the simple that is complex?take small mindful steps daily in all areas of life, but most importantly, mystically and yet simply, believe it.

The placebo effect is real because belief manifests physiologically. People rise from their deathbeds through belief.

Belief is how miracles happen. It?s where change towards overall health happens.

The power to transform your health and spirit lies in your mind. Nourish your mind, balance your diet, get up and move around, play, exercise and surely you will soon flourish. It?s all about balance and having fun with it.

Try these things out. Don?t stress over doing them, just do them and do what works for you according to your schedule. It doesn?t have to be all at once.

The mind rules. Combined with education, these are the pedals to your bike. The world is filled with helpful information. Let your curiosity thrive. Be one with the planet, your community, your social circle and yourself.

Embrace, expand, sustain, flourish.

Here are five stones to begin stepping?don?t skip over them?towards a healthier, happier, resilient body and mind:

1. Alkalize. Incorporate more alkalizing foods into your diet to raise your pH and create an internal environment inhospitable to disease causing microorganisms. Have fun with this. Check out the alkaline diet and start innovating new delicious foods and recipes into a life of vibrancy. Bonus dietary/gut aid: take a quality probiotic and eat more fermented foods like kimchi and sauerkraut (which are fun and easy to make at home).

2. Live mindfully. Emphasize relaxation and consciousness. Everyone is different, so find what works for you. Try yoga, meditation, breathing, mindful-based stress reduction, autosuggestion and focus on living in the moment and showing gratitude for the majestic beauty of all life.

3. Be social. We are social beings. Having a quality social milieu is energizing, supporting and so much more. Treat your friends like dogs?we don?t hold dogs to high expectations and are therefore forgiving and playful, while not only enjoying their company, hanging out and having fun, but also serving as a dependable, loyal companion.

4. Educate. With today?s mixed up healthcare and food systems one must take responsibility for their own health. This means learning how to properly do so and if you read this article, you already have the right mindset. Everyone is unique and knows him or herself best. Incorporate what you?ve learned here and elsewhere creatively (being creative also boosts happiness). Then keep learning, growing and feeling balanced, aware, grounded and content.

5. Believe. Believe it or not, believing can manifest reality and things can be ?all in your head.? Think happy thoughts, eat when you?re hungry, nap when you?re exhausted, exercise when energized, tell yourself a reinforcing daily mantra and believe, believe, believe in yourself, your health, your friends, your abilities and your life.

6. Bonus: Don?t take life too seriously! It doesn?t last forever. Anything helps. Be sure you don?t stress and create anxiety trying to perfectly step along these stones to health or those steps may be in vain. So remember, keep it light and have fun with it!

Cybersecurity CISPA | Outsourcing Law

The security of the Internet and privacy are key to all Cloud Computing, Mobile Computing, Social Computing and the Internet of Things (with sensors and computers in cars and anything else electrical).? Cybersecurity has profound implications for corporations, ?critical infrastructure? and individuals that depend more on cybersecurity in the commercial, economic, social and personal.

According to cybersecurity experts, the vast majority of intrusions are not disclosed to authorities for ?security reasons? or to avoid embarrassment and loss of brand value. Given the growing risks and dependencies, private companies will need to define their policies and potential goals and roles in participating, or not, in government cybersecurity programs.? This defining moment continues despite the rejection of the U.S. Senate of a bill on ?voluntary? sharing of private sector cybersecurity information with the U.S. Department of Homeland Security.

On August 2, 2012, the U.S. Senate rejected a bill that would have allowed professionals in the private sector ? whether internal or outsourced ? to share cybersecurity information with the authorities. Referred to as Cyber Intellegence Sharing Protecting Act ?(?CISPA?), the proposal would have allowed (without requiring) the private sector to share in ?good faith? information on cybersecurity and cyber threats with the Department of Homeland Security.? Following the rejection, rumors circulated that President Obama would establish an ?executive order? to allow a public-private partnership for such cooperation (?opt-in?), but this has not happened yet.

Notwithstanding the rejection of this bill in the U.S., the topic remains a matter of global news. This article explores some legal issues for projects of ?public-private partnership? to cybersecurity risks: voluntary disclosures of ?good faith,? the ?limitation of liability? for such disclosure, the scope of the rights of government use any information disclosed (including incidental extraneous private data) and legal disputes with foreign legal systems.? Such issues continue worldwide, especially in Cloud Computing?, inviting the private sector?s constant vigilance to prevent an Orwellian ?cybervoracity? of government (or at least an accommodation) and to maintain confidence in the fundamental commitments of private security.

I. Possible American Approach: A Public-Private Partnership

Conflict of Interest between Governmental and Private Sector. Basically, the government has several fundamental interests in confronting cyberrisks from the private sector. Under CISPA, the? government?s role is to protect the national defense and the ?defense industrial base? as well as private ?critical infrastructure? (transportation, banking, electricity, water and other utilities). Effective cybersecurity by government supports the continuity of government, economic prosperity and quality of life in general.

In the European Community (?EC?), the same principle applies.?? Within the EC, the Member States retain sovereign power to adopt legislative measures to restrict certain private rights to the extent that such restrictions are ?necessary, appropriate and proportionate? in a democratic society to safeguard national security (i.e., the state security), defense, public security and the prevention, investigation, detection and prosecution of crime or use without prior permission required electronic systems of communication.

Whatever the place of its business, the private sector has interests that conflict with governmental roles.? This is especially relevant in the protection of privacy. In general, as a matter of B2B and B2C business, each company collects and stores confidential information to third parties who rely on the company for not distributing it without permission. Any ?voluntary? transfer ?B2G? of this private information to the government bears the risk of government abuses (whether through negligence or intentional).

Guided by its multinational territorial footprint and the context of its activity, every private company defines its own policies for data protection, security and disclosure in accordance with the classification of data. The data can be subject to different legal regimes. Thus data can be broadly categorized as (i) internal trade secrets, (ii) external trade secrets (third party information that is confidential, received under contractual non-disclosure), (iii) information on employees, which in turn can be divided into a file and use a file regulatory labor law and private data, (iv) information on ordinary activities as transactions with customers (including personally identifiable information [PII], the information of the credit card and Demography, and (v) information relating to corporate compliance with the law (e.g., documents, accounting, tax and regulatory).

These classes have additional overlays for legal purposes.? First, any information class may also be classified as ?privileged? and therefore not disclosable in litigation.? Second, foreign laws may apply (such as in the EU) to PII and agreements between data controllers and processors.

Prerequisites to the Limitation of Liability for Voluntary Information Disclosures of Cybersecurity. The CISPA bill would have granted a general exemption against any claim by any person for the disclosure of confidential information in connection with a voluntary exchange of information with government cybersecurity. Private companies would have unlimited immunity against all civil and criminal court proceedings against any entity in the U.S. or its officers, employees or agents acting in ?good faith? who disclose information on their use of computer systems and cyber threats. This limitation of liability had been designed as an incentive for private sector entities to do what the law seeks to encourage them to do: a robust control of their own systems and networks and those of their corporate clients and sharing information on cyber threats and vulnerabilities to better protect their systems.

The ?Good Faith. To avoid potential abuse, the bill would have limited this exemption to cases of? good faith. ?The proof of this ?good faith? was an essential element to any legal exemption.

Any criterion of ?good faith? would expose the private sector to uncertainty of costs and distractions. It would invite litigation in virtually all cases. This criterion was too vague, too vague and unpredictable subtleties charged in each case of ?voluntary disclosure.?? The courts would have to decide on the legitimacy and scope of liability in special cases, such as cases of ?mixed intent? covering both ?good faith? and ?impermissible? purposes.

Continued intentions of cybersecurity. To identify the limitation of liability, the bill would require that private enterprise have a specific intent to support cybersecurity, particularly to monitor its systems or networks to identify and obtain information on cyber threats. Any other end would not justify immunity from prosecution by third parties. As the ?good faith?, this limitation also suffers from ambiguity. As in the proof of a crime, tort intentions of the actor would be called into question.

New Risks of Businesses, Individuals and Government. ?The particular provisions of CISPA would have exposed all providers of information technology and information to costs, risk and confusion.

The Lack of Confidence Client. Such a law could undermine the trust between the corporation (or providers or managers of information systems (ISP?s, for example) and the client. In the absence of contractual waivers, a ?voluntary? disclosure of confidential information to government would put suppliers, providers and managers in breach of their non-disclosure agreements. If the draft CISPA had been adopted as law, each provider and each licensee would have had to choose whether to obtain prior third party consents or rely upon governmental immunity for such disclosures. And outsourcers and other tech service providers would naturally want to be indemnified and compensated for any claim for such sharing with the government.

An Avalanche of Litigation. The legislative exemption from liability would have opened the floodgates to litigation against any company sharing of cybersecurity information with the government. ?Impugning the volunteer?s ?good faith,? a plaintiff?s lawyer might impose significant legal costs, and get significant settlements, to protect classes of victims of the same violation of rights.? Prior to dismissal, the volunteer would bear the costs of defense, preliminary hearings and pre-trial discovery.? In the case of CISPA bill, such legal costs of the defense would be the responsibility of the accused until dismissal.? ?In short, the private sector was always in danger of its first legal costs and distraction of management to defend against such lawsuits.

Class Action ?Settlements.?? ?In a class action lawsuit against a volunteer, the plaintiff?s bar might seek to impose, or threaten, substantial legal fees and risks.?? The defendant company?s ?directors and officers? liability? (and ?errors and omissions?) insurance carrier might force the insured company to settle the claim.

Financial Claims against the Government. What would be the financial responsibility of the government to compensate for mistakes or abuse by the government according to a law allowing voluntary sharing and the government?s commitment not to misuse trade secrets or other confidential data? According to CISPA bill, if the government were abusing confidential? information received in the name of cybersecurity, the government would have been liable for actual damages plus attorney fees. The bill would open the doors to litigation against the government voluntarily waiving its sovereignty for limited purposes by amending the Federal Tort Claims Act. What a gift for litigators to defend the interests of individuals and companies whose confidential information is compromised by faulty or abusive governmental disclosures! What a burden for the taxpayer and the National Treasury!

Risks of Governmental Abuses. Two types of governmental abuse can be anticipated in any public-private cybersecurity. First, citizens could neither know nor prove any abuses or breaches by government, even if (as provided in CISPA)? the government were legally barred from using personal information for purposes other than cybersecurity. ?Nobody could say whether the voluntary disclosure of self-incriminating could ?accidentally? found its way to the enforcement. Given the inability to discover or rectify any such abuses, a ?public-private partnership for cybersecurity? would devalue the trust and confidence of customers, individuals, employees, providers, assignors, licenses and other in an enterprise?s value chain.? ??An uncontrolled governmental surveillance would elicit fears of an omniscient ?Big Brother.?? ?In general, government information would be sufficiently protected, but personally identifiable information (PII) would not.

Second, the bill would have allowed governmental abuses of personal data (private or otherwise) inadvertently captured in the net of ?voluntary? disclosures on cybersecurity. ?Under CISPA, the federal government could have used private information for other governmntal purposes, so long as, in receiving information, ?at least one important goal? of the government?s use would have been cybersecurity or national security of the United States. ?This exception was a factor in the defeat of this bill because it would open the door to a Pandora?s box of unintended consequences for private enterprise.

Risk of Private Abuse. The CISPA bill would have allowed the private sector to share unlimited information with the government. There would have been no restriction as to the nature, volume or order of the data, so long as the ?good faith? test were met.? In the absence of such restrictions, any entity could freely disclose to the government a lot more information than needed, without ?pruning? or segregation, without taking efforts to limit disclosures of ?ancillary? information unnecessary to improve cybersecurity.

One can imagine scenarios of private companies ?dumping? excess data onto governmental servers. For example, a hospital could transfer to the government certain sensitive data of the patient. ?The archive might include personal health information (?PHI?), without any effort to clean or delete PHI data.? The government might use, or abuse, such PHI having an impact medical treatment, reimbursement of claims, hiring decisions, enforcement decisions unrelated to cybersecurity.?? This data would be at risk of piracy and other unauthorized uses.

Such an approach is beyond the scope of the measures necessary for the protection of privacy by law of the European Community and Canada, for example. So, a strictly American legislative ?solution? would clearly impede international trade in data processing services to European and Canadian customers, among others.

Limitations of Sovereignty: Conflicts of Law. In an integrated world, the legal implications of any ?voluntary disclosure? of cybersecurity information transcend national boundaries. ?The grant by one government (e.g., the U.S.) of immunity from liability does not grant the same immunity in all other jurisdictions. An American company would risk prosecution by foreign governments, its customers, suppliers and others in the supply chain.? Such limitation of liability would raise legal issues of reciprocity, recognition and retaliation by any other government.

II. The European Sustainable Approach: A Public

Alternatives less intrusive. The American debate on the voluntary sharing of private information on cybersecurity and its impact on privacy rights invites a search for alternative, less intrusive and more balanced.

Inter-governmental advice
. In the European Community, an approach to counseling ?independently-owned? intergovernmental exists to address these questions, but gives primary governmental emphasis on the protection of privacy, not on cybersecurity. The Working Committee # 29 on the protection of privacy, protection of personal data and cloud computing is based on a consultative approach.? It is an ?independent body? whose secretariat is provided by the European Council.? ?Reviews and papers issued by the ?Article 29 Working Party (Art. 29 WP) is independent of the European Commission. The Art. 29 WP was established under Article 30 of Directive 95/46/EC of the European Parliament and the European Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and the free movement of such data. Members of the Art. 29 WP are the authorities for the protection of private information of each member state and European institutions and the Commission of the EC. ?The Art. 29 WP has its own rules of internal procedure. Art. 29 WP has given its opinion to the Commission in February 2012 on Cloud Computing.

Trade Associations. In the United States, trade associations are empowered to organize a concerted action to advocate their common interests in the legislature. The ?lobby? can therefore promote approaches fostering providers (the ?processors?) or companies (the ?data controllers?).? In India, Nasscom advocates for service providers, but in the U.S. there appear to be no trade association for the outsourcing industry.

Adoption of Standards. National and international standards are already looking for transparency, the free exchange of data and the security of exchanges, processing and data carrier.

Alternatives more stringent
.

International Conventions. International conventions can adopt new standards on the law of the Internet. Given the limitations of any individual country?s sovereignty to exculpate the private sector civil liability for breaches of obligations to privacy, heads of state could think of a diplomatic strategy for an international convention.

The contours of such a solution exist between countries in terms of ?adequate protection? for the data privacy of the European Community. According to an agreement between the U.S. and the EC, a U.S. company that breaches its obligations (voluntarily undertaken under the ?safe harbor?) becomes subject to judicial and administrative procedures of the U.S. government for breach of contract. According to agreements under the ?binding corporate rules? (or standard contracts between providers and controllers), commercial companies doing business in several countries may elect to commit to respecting international standards under the Directive on Data Protection. ?Since the WTO has not tackled cybersecurity directly, it remains to be seen whether governments can mutually agree on substantive rights and obligations of citizens and commercial companies under such an international convention on cybersecurity. It might mean declaring a new Cold War between ?blocks? of countries, targeting countries that lack basic standards or that support ?rogue? operations or terrorist cells.

Internal Governmental Surveillance. Instead of an approach to public-private partnership, one can imagine an approach to internal espionage by each government, augmented by governmental ?guidance? or ?best practices.? ?Such an approach exists in some countries, such as China and potentially in Canada (C-30), and would serve as an equivalent to generalized surveillance. As of early November 2012, the Canadian Parliament is currently considering a bill that would allow cyber espionage on Canadian internal communications, or sometimes requiring judicial authorization.?? The Canadian government would be able to take action in cyber espionage without judicial authorization, subject to a prior assessment of several public policy considerations:

a) ?the extent to which the exemption is likely to harm the national security or enforcement of laws;
b) the fact that telecommunications service providers have the ability or inability to perform the obligations;
c) the fact that the costs of compliance with the obligations in question or not have unreasonable adverse effect on the business of the telecommunications;
d) that the obligations involved do not seriously impede the provision of telecommunications services to Canadians or the competitiveness of the Canadian telecommunications industry.?

III. Strategy Management in IT and Telecommunications

Cybersecurity legal issues affect classic businesses: merchants, ?SMEs and multinational service providers in the field of cybersecurity. ?But they affect most the trustworthiness of outsourcing service providers who depend on the Internet for their livelihood.?? The concept of ?public-private? partnering for cybersecurity poses many challenging questions for the future of outsourcing and reliability of the global services supply chain, such as:

  • What are the liabilities of outsourcing service providers for policies imposed by enterprise client?
  • What terms would apply if the outsourcing service provider wished to engage in the voluntary sharing of confidential information with the government?
  • Would it be more prudent to wait for a legal compulsion?
  • Pending new legislation, how should data be configured and made accessible?

IV. An Inescapable Symbiosis.

In conclusion, the American legislative experience suggests that private-sector ?voluntary? cooperation with police forces and national security would be a bad idea, either in the U.S. or elsewhere, for private companies and all private data providers.

In Europe, the mature age of the EU?s Directive on Data Protection (1995) and on Electronic Commerce (2002) demonstrates a balance that promotes freedom of privacy, which may yet protect government interests. Following this legislative experiment failure in the U.S., other countries will think long-term before embarking on a ?partnership? with the private sector on cybersecurity.

Maybe the U.S. will rethink the structure of its multifarious and labyrinthine laws of privacy (with multiple enforcement agencies) to protect the consumer, the consumer finance, the sick, the employer or any other victim of unauthorized access to information systems, private individual European national defense or anyone. The rejection of this bill shows that they already travel a path for more privacy and the protection of trade secrets, but that balance is a dream of government services.

That said, the private sector would not exist in a case of full cyberwar. ?Technically, both public and private sectors are symbiotic and interdependent. For example, the Stuxnet virus, according to the newspapers, had been developed by one or two governments as a tool of espionage against Iran, but also infected the computer network Chevron Corp. trading in 2010, and in response to other international companies are targeted by cyber attacks. This mutual interdependence evokes a need for more ?best practices? and more non-statutory collaboration between public and private sectors to protect both sectors.? CISPA is dead, but not forever.

Take a very, very close look at the roundedged Wii U proprietary discs

There's something immediately striking about Nintendo's Wii U proprietary disc format that's hard to notice in photos -- it's got rounded edges, both outside and in. It feels different than any other disc we've handled before; Tim swears he's seen a round-edged disc in the wild, but we've never seen such a thing ourselves. It's as if the folks at Nintendo took sandpaper to every edge of every disc, making them all the more friendly to the touch. It's a little detail, but it's a nice one.

As we learned when the console was initially announced, the Wii U's "proprietary high-density optical discs" hold up to 25GB of data -- equivalent with that of Sony's single-layer Blu-ray format on the PlayStation 3, and much larger than the Xbox 360's dual-layer DVD format. Of course, all logic and statistics aside, having now handled a round-edged disc, we never wanna go back. We've taken some super up-close photos of Wii U karaoke title Sing Party, as well as comparison shots alongside its hard-edged Xbox 360 and PlayStation 3 brethren, which can be found in the gallery below.

Why men like Petraeus risk it all to cheat

An admitted affair has crumbled the career of CIA Director David Petraeus, prompting the evergreen question: Why do people with so much to lose risk it all for sex?

In the last few years alone, several public figures, from former Rep. Anthony Weiner to action star and former California Gov. Arnold Schwarzenegger, have admitted to straying from their marital vows. In Petraeus' case, a miscalculation of risk may have contributed to the decision to cheat, psychologists say.

"People tend to underestimate how quickly small risks mount up" because of repeated exposure to those risks, said Baruch Fischhoff, a professor of social and decision science at Carnegie Mellon University. "You do something once and you get away with it ? certain things you're probably going to get away with ? but you keep doing them often enough, eventually the risk gets pretty high."

Even so, men can become blind to risk at the sight of an attractive woman, and from an evolutionary perspective, cheating can be a positive mechanism for ensuring gene survival, regardless of risk, scientists say.

Military affairs

Petraeus, a retired four-star general, resigned his post as CIA Director on Friday (Nov. 9), admitting to an affair with Paula Broadwell, his biographer. Twenty years the general's junior, Broadwell had close access to Petraeus for several years, but their affair reportedly did not start until after he left the military in 2011.

A West Point graduate, Broadwell is a lieutenant colonel in the U.S. Army Reserves. She reportedly bonded with Petraeus over physical activity, going on runs with him and remaining a close confidant after Petraeus' military career ended.

That time together likely contributed to the intimacy between Petraeus and Broadwell, said Frank Farley, a Temple University psychologist, just as many people begin affairs after getting close in the workplace.

Petraeus is not the first high-ranking military man to have an affair, said Farley, who is also a past president of the American Psychological Association. Famously gruff World War II general George Patton had an affair with his wife's step-niece. General Douglas MacArthur had a mistress named Isabel Rosario Cooper, whom he met in the Philippines.

And General Dwight D. Eisenhower, later president, may have had an affair with his World War II chauffer, Kay Summersby, according to the woman's memoirs and some suggestive letters left behind after both parties died.

"The nation should not be surprised at Petraeus having an affair," Farley told LiveScience.

Leaders like Petraeus tend to be bold risk-takers, Farley said, a personality trait that is very helpful when leading soldiers into battle. The same trait may make these leaders more likely to take risks in their personal lives, as well. [10 Easy Paths to Self Destruction]

Broadwell may have some of the same risk-taking traits as the former director. In a January interview with The Charlotte Observer, Broadwell, who is also married, called herself and her husband "adventure junkies."

Risk versus reward

Still, Petraeus' 38-year marriage and his career were at stake in his decision to pursue an affair. Extramarital liaisons are especially risky for CIA employees with access to classified information, because an affair can leave the person open to blackmail.

There are also concerns that Broadwell could have gotten classified information from Petraeus. For example, in a speech in Denver in October, Broadwell brought up details about the U.S. Consulate attack in Benghazi that may not have been public knowledge, according to The Daily Beast.

With risks like that on the line, could an extramarital affair be worth it? As it turns out, men may become blind to risk when an attractive woman enters the picture. One 2008 study found that men who played blackjack after seeing beautiful female faces took more risks than men who played the game after seeing unattractive faces.

This was true if the men were highly motivated in seeking new sexual partners. The blackjack risks seemed calculated to impress potential mates, study researcher Michael Baker, now a professor at Eastern Carolina University, told LiveScience. [The Sex Quiz: Myths, Taboos & Bizarre Facts]

More germane to high-profile affairs, Baker said, the risk of losing one's career or reputation is nothing compared with the evolutionary drive to reproduce. In that sense, while embarking on an affair may seem dumb, it actually shows something called "mating intelligence."

"These individuals have these very high-status, high-power positions, and the whole idea behind why people might be motivated to get these positions is because it gives them better access to resources that could be used to increase their reproductive success and attract more mates," Baker said.

Until the last few decades, extramarital affairs wouldn't have put a crimp in the careers of high-profile men, Baker said. It's only recently that men have been subject to the consequences of infidelity. And, of course, monogamy is often a lofty ideal.

"The human race has had thousands of years of problems with monogamy," Farley said. "The problems have not been resolved."
